Carcinogenic Drug Case Against Amneal Heads to Federal Court

On Monday a case was removed from the District Court of Douglas County, Nebraska to the Nebraska District Court. The case was filed by Chris Conrad, Sally Conrad, and Taylor Bishop against Amneal Pharmaceuticals. The case is regarding product liability for the product Metformin.

Metformin was a prescription medication that was used in the treatment of diabetes and poly-cystic ovarian syndrome. However, the complaint alleges that several batches of the drug tested positive for carcinogens.

The plaintiff was prescribed the medication and took the product in 2018 and 2019. After taking the medication, the plaintiff developed thyroid cancer, a known likely effect of the carcinogen. The plaintiff accuses the defendant of failing to test and review their products as well as failing to recall the medication prior to the mandated Food and Drug Administration recall.

The plaintiffs are suing for medical expenses. The plaintiffs are represented by Gross & Welch. The defendants are represented by Kirkland & Ellis and Rembolt & Ludtke
