On Friday a case was filed in the District Court for the Eastern District of New York by Pharmaseek LLC against Romark Global Pharma LLC. The case alleges a breach of contract regarding the payment for clinical trials regarding COVID-19 treatments.
Romark, the complaint says, allegedly contracted with Pharmaseek LLC to seek clinical trial data regarding the safety and efficacy of the drug Nitazoxanide for the treatment of COVID-19. As a part of this contract, Pharmaseek arranged for the collection of information from hospitals and for basic collation of data.
The information was then purportedly submitted to Romark Puerto Rico, which plaintiff believes was turned over to Romark Florida, Romark Puerto Rico’s sister company. However, the complaint said that no payment was made per contract and Romark Puerto Rico claims insolvency. Per the plaintiff’s theory, Romark Puerto Rico was created as a shell company for the express purpose of defaulting on the contract to the benefit of the real party Romark Florida.
Pharmaseek is suing for breach of contract and unjust enrichment. They are represented by the firm of Stern & Eisenberg.
